“Credibility of institution cannot be affected by newspaper reports”, says CJI, Refuses hearing of PIL on Justice Joseph’s interview

A three-judge SC bench headed by CJI Gogoi today declined to give an urgent hearing in a plea seeking a probe into retired SC judge Justice Kurian Joseph’s recent interview to a national daily.

The petitioner, lawyer Shashank Deo mentioned before the SC bench that an investigation needs to be conducted into the interview given by Justice Joseph on January 12.

Justice Joseph, in his interview on January 12, has said former CJI Dipak Misra was perceived to be under the influence of external forces.

His statement was apparently in connection with the unprecedented press conference held in January this year, in which Justice Joseph along with 3 senior-most SC judges have expressed displeasure with the former CJI Dipak Misra and with the way he was assigning cases.

Deo told the SC bench that the interviews or statements given to media – such as the one given by Justice Joseph – affect the very “credibility of the institution”.

In response, CJI Gogoi said:

Credibility of the institution can be maintained by those who man it and not by newspaper reports”.

The CJI then refused to give an urgent hearing to the PIL, and reiterated:

We will do our job and everyone else should do theirs.”
